Social Garden is a platform that connects influencers and creators with brands. With Social Garden, customer loyalty to your own product is increased and customers generate high-quality content and stories. Social Garden business customers benefit from the qualitative customer data and the further marketing of the customer-generated content.

When this data protection declaration speaks of „Social Garden“, „Social Quest GmbH“ or „we“, it means Social Quest GmbH with registered office at Am Heumarkt 4, A-1030 Vienna, Austria, which is responsible for the processing of user-related personal data responsible under this privacy policy.

We, a company based in Austria, process data exclusively in compliance with the legal provisions (in particular the General Data Protection Regulation, GDPR for short, which came into force on May 25, 2018).

Public bodies that receive personal data in the context of a specific request in accordance with European Union law or the law of a member state are not considered as recipients; the processing of this data by public bodies should be carried out in accordance with the applicable data protection regulations depending on the reason for the data processing.

Third person
„Third Party“ is a natural or legal person, public body, agency or other legal entity that is not the data subject, controller, processor or a person under direct direction of the controller or processor and is authorized to process personal data .

„Consent“ is the data subject’s free, specific consent to the processing of their data, given after receiving the necessary information and clearly indicating the data subject’s wishes. This occurs through an utterance or through setting a clear action.

b. What does Social Garden?

There are many different ways you can use our Services, find and share information. How to communicate with others and create new content. If you share information with us (e.g. by creating a Social Garden Account and specifying your personal preferences and interests), we can make our Services even better by showing you more content that is personally relevant to you, connecting you with people, you Premium Services can enjoy or we make it even easier and faster for you to share content. As the operator, we have taken several technical and organizational measures to ensure the greatest possible protection of the data processed on this website/app. Nevertheless, Internet-based data processing can have security gaps, so absolute protection cannot be guaranteed. c. Why are we processing data?

Rest assured that we process your data exclusively in compliance with the legal provisions (GDPR, TKG 2003, etc.) for the following purposes:

By completing Contributions to Campaigns on Social Garden, you grant Social Garden a nonexclusive, transferable, sublicensable, worldwide license to use any Content (including photos, videos, audio, text,…) that you submit to Social Garden .

Social Garden can in turn transfer the rights to your content (photos, videos, audio, texts,…) to its partners. By creating a user account and providing your data, you agree that we may process and pass on your data.

Data processing takes place on the basis of the legal provisions of § 96 Paragraph 3 TKG and Art 6 Paragraph 1 lit a (consent) and/or lit b (necessary for the fulfillment of the contract) of the DSGVO.

d. What are our principles of data processing?

Our principles of data processing are:

Data processing happens exclusively in accordance with the law, fairly and transparently („lawfulness, fairness and transparency“)
The data is specified and collected for legitimate reasons and not further processed in a way that is inconsistent with these principles.
Adequate, relevant and limited to what is necessary to achieve the purposes for which the data is collected (“data minimization”)

We only process personal data if and to the extent that at least one of the following applies:

The processing is necessary to comply with a legal obligation to ensure that Social Garden as a controller of personal data.

Withdrawal of consent by the data subject does not apply to cases falling under points 1. and 2. Social Garden, in its capacity as controller, does not process personal data that discriminates on the basis of racial or ethnic origin, political orientation, religion or philosophical belief, economic affiliation, genetic, biometric data, discrimination regarding health, sex life, sexual orientation of the natural person, as long as the data subject has not given their explicit consent to this processing.

Information you give us (e.g. many of our services require you to create a Social Garden account. You will be asked to provide personal information such as email address, name)

Information we receive about the use of your Social Garden account. We collect information about the Services you use and how you use them (e.g. when you watch a video). This information includes:

Device information (hardware model, system information, device identifiers, network information, mobile phone number). Social Garden may associate your device information or phone number with your Social Garden account.
Log information: when you use our services or view content provided by Social Garden, we automatically collect data and store certain information in server logs. This includes:

Details about how often you use Social Garden Services, such as time you watch videos
Internet protocol address.
Device event information, such as crashes, system activity, hardware settings, browser type, browser language, date and time of your URL query
Cookies that uniquely identify your browser or Social Garden account location information.

If you use Social Garden, we may collect and process information about your current location. This allows us to show you the most relevant content in your language or country. We use different technologies to determine your location, including IP address, GPS and other sensors that give us information about devices in your vicinity, for example, WLAN access points and cell towers.
Unique registration number
Certain Services contain these numbers (e.g. operating system type and application version numbers), which may be sent to Social Garden when you install or uninstall that Service or when that Service connects to our servers.
Local memory
We may collect and store information (including Personal Information) locally on your device. We use mechanisms such as browser web storage (incl. HTML 5) and app caches.

We do not share your personal information with companies that we do not work with, unless one of the following applies:

We also use the information for our brands that have business accounts on Social Garden and make this data available for Social Garden campaigns created by Social Garden Brands. We may use the name you use for your Social Garden profile. If you have a Social Garden account, we may use your profile name, profile photo and the activities you post on Social Garden. We will respect your privacy settings in your Social Garden account.

When you contact Social Garden, we record the communication to help you resolve issues. We will inform you about innovations or improvements. We use information from cookies and other technologies, such as pixel tags, to improve your user experience and the overall quality of our services.

For example, through your language preferences, we may provide you with the Services in the language you prefer. We will ask for your consent before we use your information for any other purpose not covered by this privacy policy. Social Garden processes information on our servers located around the world. We may store your personal information on servers located outside your country of residence (GDPR compliant countries).

i) What am I responsible for as a user?

By uploading content (e.g. photos, videos, audio material, texts…) you confirm that you have all copyrights and rights of use to this content or the consent of the authorized persons or persons recognizable on the image/video/audio materials . Social Garden assumes no liability for the content uploaded by users.

Uploading the following content is prohibited:

depiction of violence
Nudity (visibility of primary and secondary sexual characteristics)
Pornography/Child Pornography
Content that is incompatible with the applicable youth protection regulations
Generally (criminal) illegal content

The compatibility of the uploaded content with the terms of use is regularly checked by Social Garden (on a random basis and based on reports). Content that contradicts the terms of use will be deleted without exception.

Furthermore, Social Garden reserves the right to report criminal acts at any time or to inform users or other persons who are harmed by the uploaded content about the identity of the accused user in order to enable them to report the crime.

You also agree that you will be responsible for any data charges you incur while using the Service.

j. How does Social Garden make money?

We offer brands the opportunity to use your posted stories for advertising purposes. We get our money for this and can offer you this service free of charge. Our partners publish the stories on their own advertising channels with reference to you, as the creator.

The developed reward system is made available to the brand manufacturers. Social Garden provides the tool, so to speak, for awarding brand-oriented points. The conditions of the reward system of the respective brand are determined by the respective company itself. Social Garden is therefore not liable for the content or the conditions of participation of the respective reward systems.

k. What are cookies?

Our website uses so-called cookies. These are small text files that are stored on your end device with the help of the browser. They do no harm.

We use cookies to make our offer user-friendly. Some cookies remain stored on your end device until you delete them. They enable us to recognize your browser on your next visit. If you do not want this, you can set up your browser so that it informs you about the setting of cookies and you only allow this in individual cases. All of them are world leaders in their field and adhere to strict data protection regulations such as „PrivacyShield“, the certification technology for US companies. We have entered into strict data processing agreements with these companies, which oblige them to maintain the highest security standards in data processing.

Rocket Science Group LLC d/b/a MailChimp helps us when you choose to receive newsletters and helps us make newsletters more relevant by letting us know who subscribes to a newsletter and who doesn’t. This allows us to increase the relevance of newsletter content. You can unsubscribe from receiving newsletters at any time. The link to this is included in every newsletter. Hubspot, Inc. Helps us to organize our users‘ contact details and track user status, e.g. whether you are a premium user or a regular student and we also use it to maintain our blog and news section. Google Ireland Limited will help us with authenticating your Google user/channels and user service emails if you email [email protected] or one of our team members. q. Children’s Personal Data

Our website is not suitable for use by minors/children under the age of 16. We assume that credit card purchases initiated through our website are made by adults. This Privacy Policy is designed for adult use to comply with the GDPR and other legal requirements. We will never knowingly collect personal information from children under the age of 16. If we learn that we have information from children under the age of 16, that information will be promptly deleted from our servers. 3. Correction (if data is incorrect)

You have the right to receive information and correction of inaccurate personal data concerning you from the controller within one business day. You have the right to complete incomplete data

4. Deletion (right to be forgotten)

You have the right to request the controller to erase your personal data without undue delay and the controller has the obligation to process personal data without undue delay in the following cases, unless the processing is necessary:

The personal data are no longer necessary in relation to the aims/purposes for which they were collected
The data subject has withdrawn consent, which means that the processing is no longer lawful (Art 6 (1), Art 9 (2) (a) GDPR)
The data subject objects to the processing pursuant to Art 21(1) or (2) GDPR and there are no overriding legal grounds for the processing
The personal data have been unlawfully processed
The personal data must be deleted due to compliance with the law of a member state (to which the data subject or the controller belongs).
The personal data was collected for the purpose of providing information services in accordance with Art 8(1) GDPR

Where the controller has made personal data public and is required to erase it under Article 17(1), the controller must take all reasonable steps, given the available technology and cost, including technical measures, to inform other controllers that the data subject has requested the erasure of his/her personal data, unless the processing is necessary

5. Restriction of Processing

You have the right to have the processing of your data restricted by the controller if one of the following cases applies:

The accuracy of your personal data is confirmed by you for a period of time to enable the controller to verify the accuracy of your personal data.
The processing is not lawful and you request the restriction of your personal data instead of the deletion
The controller no longer needs your personal data for the purpose of processing, but they are necessary for you to enforce or defend your legal claims
You have objected to the processing pursuant to Art. 21 (1) GDPR and the verification is ongoing as to whether the rights of the controller take precedence over the interests of the data subject

6. Transmission (data transmission)

You have the right to receive all personal data concerning you, which the controller has received, in a structured, commonly used and machine-readable form. You have the right to transmit this data to another controller without Social Garden having any influence, provided that the processing is in accordance with the GDPR.

Furthermore, you can have your data transferred directly from one controller to another controller in accordance with Art. 20(1) GDPR, provided this is technically possible and provided that this does not restrict the rights of the controller or third parties. You have the right to object to the processing at any time based on your current situation (Art 6 (1) (e) and (f) GDPR). Once you have objected, Social Garden must stop processing your personal information unless we can demonstrate legitimate grounds to the contrary that override your interests, rights and freedoms. If we use personal data for marketing purposes, you have the right to object to this at any time. In such a case, Social Garden will not use your personal data for direct marketing in the future. Furthermore, you can object at any time to Social Garden using your personal data for scientific, historical or statistical purposes, unless the processing is in the public interest.

7. Automated individualized decision-making, including profiling

As a responsible company, we do not use automated decision-making or profiling.

8. Right to Withdraw Consent

Any data subject has the right to withdraw his or her consent to data processing at any time. Social Garden will respond to such a request from the data subject within one month of receipt. This period may be extended by a further 2 months if necessary. Social Garden will inform the data subject of such an extension within one month from receipt of the request, stating the reasons for the extension. This information shall be sent to the data subject electronically, unless the data subject requests the reply in another way.

Our privacy policy applies to all services provided by Social Garden and its affiliates. This does not apply to services that are explicitly subject to their own data protection regulations.
